Reputational risk is an increasingly fundamental aspect of legal strategy.
With Open Justice a foundational aspect of the English legal system, the shift to an online-focused news environment has served to exacerbate the reputational risks of engaging in litigation. These risks often compete with financial losses or a desire for justice and create a powerful tension that litigators and leaders cannot ignore when making critical decisions.
This tension is now being accelerated by the increasing prevalence of generative AI for searches and research, resulting in media coverage around disputes being more easily accessible to business partners, their stakeholders and the general public.
The panel, outlined below, includes PR and legal analytics specialists, as well as litigation funders and solicitors with leading GC experience. The discussion will explore these tensions, covering a number of high-profile cases, considering how media coverage varies across different disputes, and how this feeds into strategic decision-making from a legal, funding and public relations perspective.
